City Lawyer Blasts Kitui Assembly Clerk for Blocking Speaker’s Impeachment Motion

Tensions in the Kitui County Assembly have escalated after Nairobi-based lawyer Morris Kimuli accused the Acting Clerk of illegally blocking a motion seeking to impeach Speaker Kevin Kinengo Katisya.

In a strongly worded letter dated September 30, 2025, Kimuli, acting on behalf of Hon. Sylvester Kitheka Munyalo “Yaamu” said the Clerk had no legal authority to reject or return the impeachment motion. “Rejection of motions is above your paygrade,” the lawyer declared, accusing the Clerk of dishonesty and bias.

 

Kimuli cited the Supreme Court decision in Mike Sonko v Clerk, Nairobi County Assembly & Others, noting that an impeachment motion is valid if signed and supported with ID numbers. “The Supreme Court was clear. Anything else is an invention meant to frustrate due process,” he said.

On the Clerk’s claim that the motion’s mover was “unknown,” the lawyer scoffed at the contradiction: “How then did you return the motion to Hon. Munyalo, send him a text, and even write him a letter? The dishonesty is laid bare.”

The lawyer further dismissed claims that the motion was sub judice, insisting such matters can only be raised on the floor of the Assembly. “Questions of sub judice are for Members to raise during debate and for the Speaker to rule on not the Clerk,” Kimuli argued.

Crucially, the letter invoked Standing Order 43A(2), which states that if a motion is not tabled within seven days, it is deemed approved. “By operation of law, Hon. Kevin Kinengo Katisya will cease to be Speaker. No man can be a judge in his own cause,” Kimuli warned, adding that Munyalo would move to court to bar Kinengo from office and benefits if the motion is not processed.

The fiery letter, copied to both Speaker Kinengo and Deputy Speaker Christopher Nzilu, ended with a direct attack on the Clerk: “Your conduct manifests your unsuitability to hold the office you hold, and that constitutes a basis for your removal.”
